The Failure of the 28-Clause Peace Initiative for Ukraine: How Peace Negotiations Continue to Stumble

Europe breathed a deep collective sigh of relief on Monday, as the tension caused by the introduction of a new 28-article proposal for resolving the conflict appeared – temporarily – to have been defused. A Washington representative spoke of "notable headway" after bilateral negotiations in Geneva. On Monday night, Russian leadership made its response: another massive barrage of aerial bombardment on Kyiv.

The Rhythm of Negotiation and Warfare

The succession of opposing developments captured the bleak nature of the recent timeframe. By day, diplomatic battles are waged: hopeful statements are issued from different nations. Considerable effort is expended on restraining certain initiatives. By night, Russian leadership brutally reminds the world that, for them, war remains the key method for achieving "settlement".

Nocturnal Warfare

As the offensive unfolded into the early hours of Tuesday, the current condition of Ukraine's defenselessness was exposed. Ukraine is able to track projectile deployments from Russian territory, a capacity provided through timely intelligence. From witness perspectives, Ukrainian air force fighter jets that had been scrambled to engage hostile cruise missiles roared overhead – advanced fighter aircraft supplied to Ukraine by NATO members.

Shortly after, Kyiv's missile defense thundered: several firings fired to intercept a Russian ballistic missile. This was a modern interception technology at work, most likely provided by partner states. Every firing shakes the surroundings, rattling buildings. The brief panic quickly gives way to resigned acknowledgment: possibly the hostile projectile won't strike its target this time, preventing destruction from devastation and another blackout.

Ongoing Risks

Not long after, a large-caliber weapon fired at a drone close by, part of a rapid response unit – almost certainly allied-provided weaponry. Unfortunately, the shots failed to hit the opposing UAV – it maintained course toward its objective.

Intermittently, this carried on until dawn. Kyiv awoke to the daybreak reports: several casualties, damage and heating outages in many homes as a result of the night's assault. As always, everyone still maintained normal activities – experiencing conflict. But those 24 hours illustrated Ukraine's critical military reliance on international aid – a reliance that neighboring countries are clearly incapable to substitute in the near term.

Ineffective Peace Efforts

The detailed framework from Washington sparked intense emotion, controversy and serious worry – and briefly redirected concern from Ukraine's largest corruption scandal in years. Yet, we have witnessed similar scenarios, after prior negotiation attempts and bilateral conferences.

Every new initiative from Washington adheres to the same pattern: a negotiation push against Ukraine, which Kyiv, with other European capitals, succeeds in resisting. They contain the crisis but never actually secure success. This cycle will, undoubtedly, endure.

Strategic Calculations

It is tempting to accuse specific actors of repeatedly advocating Moscow's conditions. But that does not seem to be the entire situation. American leadership operates on a assumption understood by international relations experts: you cannot win at the negotiating table what you have lost on the battlefield. The White House believes that it is unrealistic to force Russia to abandon the land that it presently holds in Ukraine's south or east.

The challenge is that while accepting these circumstances, Washington does nothing to prevent Kremlin actions, through diplomacy or military means, from believing that the status quo will not change more in its benefit in the coming year.

Conflicting Perspectives

Therefore, Moscow is certain that duration works to their advantage – that Ukraine and its supporters are nearing depletion. Their motivation to sign a deal that does not give them the greatest potential benefit is virtually nonexistent. There may be numerous efforts to end hostilities, but they will continue as long as Russia's government remains completely certain in the conclusion.

On the contrary, Kyiv believes that Ukraine can still hold out, gradually sacrificing civilians and areas but averting a total frontline collapse until situations evolve in its advantage.

Present Conditions

Realistically, there are no real preconditions for a armistice. Now, subjective factors are entering the equation: leadership ambitions to broker a ceasefire and obtain worldwide acknowledgment, and the government's dual difficulties – on one hand, not to alienate a key ally, and on the other, to mobilize citizens around the flag against any plan Kyiv finds unworkable, so that their priority does not move to internal issues. And although their mission will now be significantly challenging after current events, it remains highly unlikely that this will change their overall approach.

These conflicting dynamics are guiding negotiations.

Summary and Prospects

It took a only one week to terminate the suggested clauses of the latest plan. Assertive and inconsistent approach of the matter by American leadership, pushback by Ukraine and the other European countries, along with pacifying measures of negotiators, and finally, latest revelations, all served their function.

While new plans based on established approaches are forthcoming, Kyiv, London and other allied nations should arrive at a critical understanding: Ukraine and Europe will only be able to fend off diplomatic offensives from Washington that are based on Russian demands and show specific hesitation to change the course of events, if they maintain solidarity and improve their protective measures at a significantly accelerated rate. If they do, no combination of diplomatic or military actions will be able to overcome them. In the meantime, Ukraine's ability to defend against evening bombardments will, for the coming months, largely rely on sustained allied backing.
